TOWN OF CRAWFORD
INTRODUCTORY LOCAL LAW
OPT-OUT OF ALLOWING CANNABIS DISPENSARIES AND ON-SITE CANNABIS CONSUMPTION ESTABLISHMENTS
BE IT ENACTED by the Town Board of the Town of Crawford, County of Orange, New York, as follows:
Section 1. Legislative intent and authority.
The intent of this local law is to opt the Town of Crawford out of hosting retail cannabis dispensaries and on-site cannabis consumption establishments within its municipal boundaries. The Town of Crawford wishes to exclude these establishments from the Town because_______]. This local law is enacted pursuant to Section 131 of the NYS Marijuana Regulation and Taxation Act, which expressly authorizes towns to opt-out of the state’s authorization to allow retail cannabis dispensaries and/or on-site cannabis consumption establishments to locate and operate within their boundaries, and the state Municipal Home Rule Law.
Section 2. Opt-out.
The Town Board of the Town of Crawford, County of Orange, hereby opts-out of licensing and establishing cannabis retail dispensaries and cannabis on-site consumption establishments within its boundaries. Such establishments shall not be permitted in the Town of Crawford.
Section 3. Severability.
If a court of competent jurisdiction determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 4. This local law is subject to permissive referendum.
Section 5. Effective date.
This local law shall take effect immediately upon filing with the Secretary of State.
