NOTICE OF HEARING
INTRODUCTORY LOCAL LAW
AFFORDABLE HOUSING IN BP-HAMLET ZONING DISTRICT
PUBLIC NOTICE is hereby given that there has been introduced before the Town Board of the Town of Crawford, New York, on June 16, 2022, a local law, titled “Affordable Housing In BP-Hamlet Zoning District,” which local law would authorize affordable multiple dwellings as a special permit use in the Business Park-Hamlet (BP-Hamlet) zoning district and establish bulk and other requirements for the use.
A complete copy of the Introductory Local Law is available for inspection at the Clerk's Office.
NOW, THEREFORE, pursuant to Section 20 of the Municipal Home Rule Law, the Town Board of the Town of Crawford, New York, will hold a public hearing on the aforesaid Local Law on July 21, 2022, at 7:00 P.M. or soon thereafter, at the Town Hall, 121 Route 302, Pine Bush, New York, 12566, at which time all persons interested therein shall be heard.
The Town of Crawford will make every effort to assure that the hearing is accessible to persons with disabilities. Anyone requiring special assistance and/or reasonable accommodations should contact the Town Clerk.

INTRODUCTORY LOCAL LAW
AFFORDABLE HOUSING IN BP-HAMLET ZONING DISTRICT
BE IT ENACTED by the Town Board of the Town of Crawford, County of Orange, State of New York, as follows:
Section 1. Legislative Intent. The intent of this local law is to allow and encourage the construction of affordable housing in the Business Park-Hamlet zoning district on sites that adjoin existing housing developments. It is intended that such affordable dwelling units will be available for rent to work force, veteran, special needs and senior citizen occupants.
Section 2. Column 2, titled “Special Permit Uses,” of the Table of Use Regulations for the BP (Business Park) Zoning District, authorized by §137-8, titled “Table of Use Regulations” of Chapter 137, titled “Zoning,” of the Code of the Town of Crawford is amended by adding a new special permit use, permitted only in the BP-Hamlet (Business Park-Hamlet) zoning district, to read as follows:
17. Affordable multiple dwellings (in BP-Hamlet zoning district only)
Section 3. Section 137-28, titled “Special conditions and safeguards for certain uses,” of Chapter 137, titled “Zoning,” of the Code of the Town of Crawford is amended by adding a new subsection W, titled “Affordable multiple dwellings in BP-Hamlet zoning district,” to read as follows:
W. Affordable multiple dwellings in BP-Hamlet zoning district.
- All dwelling units shall be affordable to lower-income or moderate-income persons pursuant to income levels determined by New York State and/or Federal agencies.
- The provisions and requirements of §137-28E shall not apply. Notwithstanding the bulk requirements contained in the Table of Dimensional Regulations for the BP-Hamlet zoning district, the bulk requirements shall be as follows:
- Minimum lot size: 2 acres
- Minimum lot width: 100 feet
- Minimum front yard setback: 75 feet
- Minimum side yard setback (each): 25 feet
- Minimum rear yard setback: 40 feet
- Maximum building height: 35 feet
- Maximum building coverage: 40%
- Minimum distance between buildings: As determined by Planning Board during special permit review
- Density: 20 dwelling units per gross acre
- Minimum habitable floor area:
1 bedroom:450 square feet
2 bedrooms: 700 square feet
3 bedrooms:800 square feet
- Mix of dwelling units: One (1) three-bedroom dwelling unit is permitted for a caretaker. The remaining dwelling units shall be an equal number of one- bedroom units and two-bedroom units.
- Parking requirement: 1.5 spaces per dwelling unit
- Municipal water and sewer service must be available to service the site.
Section 4. Severability. If a provision of any article, section, subsection, paragraph, subdivision or clause of this local law shall be adjudged invalid by a court of competent jurisdiction, such order or judgment shall not affect or invalidate the remainder of any article, section, subsection, paragraph, subdivision or clause of this local law.
Section 5. Supersession. Pursuant to the state Municipal Home Rule Law, this local law is intended to and shall supersede any inconsistent provisions of the state Town Law and any other special law.
Section 6. Effective Date. This local law shall take effect immediately upon filing with the Secretary of State.
