CRAWFORD TOWN BOARD

NOTICE OF ADOPTION OF LOCAL LAW

SUBJECT TO PERMISSIVE REFERENDUM

            NOTICE IS HEREBY GIVEN that the Town Board of the Town of Crawford, at a special meeting held on July 27, 2021, after issuance of a SEQR Negative Declaration for this Unlisted action, duly adopted a local law, subject to permissive referendum, titled “Opt-Out of Allowing Cannabis Dispensaries and On-Site Cannabis Consumption Establishments,” which local law opts-out the Town of Crawford from the state statute authorizing towns to allow the licensing and establishing of cannabis retail dispensaries and cannabis on-site consumption establishments within the Town, and thus prohibit such establishments in the Town of Crawford.

Coterminous Town/Village Petition for Consolidation

The Supervisor and Town Board support the Coterminous Town/Village petition for Consolidation. The attached question and answer sheet should answer most questions. This petition allows the Town to put this up for a vote by the residents in the Spring of 2022. If this is passed by the voters this consolidation would protect our current zoning and eliminate the possibility of new entities being formed within the Town’s borders. In a state as costly to live in as New York this should help keep the taxes more stable than what they would be if new entities are formed. Protect your values, including open space and strict zoning that were outlined in the Town of Crawford master plan and sign a petition for a vote on this consolidation. Should you have any further questions reach out to the Town Supervisor, Town Clerk or any Town Board member and we would be happy to answer them.

INTRODUCTORY LOCAL LAW

OPT-OUT OF ALLOWING ON-SITE CANNABIS CONSUMPTION ESTABLISHMENTS

            BE IT ENACTED by the Town Board of the Town of Crawford, County of Orange, New York, as follows:

Section 1.        Legislative intent and authority.

The intent of this local law is to opt the Town of Crawford out of hosting on-site cannabis consumption establishments within its municipal boundaries. The Town of Crawford wishes to exclude these establishments from the Town because ________This local law will not exclude cannabis retail dispensaries from the Town. This local law is enacted pursuant to Section 131 of the NYS Marijuana Regulation and Taxation Act, which expressly authorizes towns to opt-out of the state’s authorization to allow on-site cannabis consumption establishments to locate and operate within their boundaries, and the state Municipal Home Rule Law.

Section 2.        Opt-out.

The Town Board of the Town of Crawford, County of Orange, hereby opts-out of licensing and establishing on-site cannabis consumption establishments within its boundaries. Such establishments shall not be permitted in the Town of Crawford.

Section 3.        Severability.

If a court of competent jurisdiction determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 4.        This local law is subject to permissive referendum.   

Section 5.        Effective date.

This local law shall take effect immediately upon filing with the Secretary of State.

STATE OF EMERGENCY ORDER NO. 1

WHEREAS on March 13, 2020, I declared and proclaimed a disaster emergency in the Town of Crawford and ordered the temporary suspension of certain policies, rules and laws; and

WHEREAS, said State of Emergency was extended on May 15, 2020; and

WHEREAS, it is necessary to temporarily suspend and modify parts of certain additional local laws, ordinances, order rules and regulations to assist and aid in coping with the health disaster.

NOW, THEREFORE, I, Charles E. Carnes, Supervisor of the Town of Crawford, by virtue of the authority vested in me by Section 24(g) of Article 2-B of the Executive Law to temporarily suspend or modify any local law, ordinance, order, rule or regulation or parts thereof during a disaster emergency, if compliance with such local law, ordinance, order, rule, or regulation would prevent, hinder or delay action necessary to cope with the disaster emergency, or if necessary to assist or aid in coping with such disaster, I hereby order the following additional suspension:

Those parts of the Town of Crawford’s Zoning Code, laws, rules and regulations and planning approval requirements which pertain to outdoor dining and drinking conducted on or adjacent to the premises of existing restaurants, eating and drinking places, fast food establishments, delicatessens and similar establishments with the approved indoor seating, subject to the provider complying with all the New York State safety and other regulatory requirements issued under the Governor’s applicable Executive Order and provided that the dining and drinking areas are not set up in fire lanes or other areas where they would significantly impede emergency responses or the flow of traffic in the judgement of the Town’s Code Compliance Department.

Said suspensions shall run from the date the Town of Crawford, along with other municipalities in the region, enters the Phase 2 reopening pursuant to the Governor’s Executive Order(s) and run through the date of termination of the Town’s state of emergency, subject to extension by further order.

The purpose of the special meeting is to hold four public hearings, on the Town of Crawford Route 302 Pedestrian Improvements, Introductory Local law – Addition to Opt-Out of Real Property Tax law 487 Exemption, FY-2021 CDBG Funding Application and Proposed Introductory Local Law “Farm Related Zoning Amendments”.
