PLAN OF JOINT AGREEMENT BETWEEN THE TOWN OF SHAWANGUNK

IN THE COUNTY OF ULSTER AND THE TOWN OF CRAWFORD

IN THE COUNTY OF ORANGE

CONSOLIDATION OF THE PINE BUSH FIRE DISTRICT TO

INCLUDE THE NEW PROSPECT FIRE PROTECTION DISTRICT

FOLLOWING THE DISSOLUTION OF THE NEW PROSPECT

FIRE PROTECTION DISTRICT BY THE TOWN OF SHAWANGUNK

 

Pursuant to section 752 in Article 17-A of the General Municipal Law

 

  1. The names of the fire district and the fire protection district involved in this proposed consolidation are the Pine Bush Fire District of the Town of Crawford and the New Prospect Fire Protection District of the Town of Shawangunk. Following the completion of these proceedings on or before December 31, 2022 and after 12:00:00 AM on January 1, 2023, the Pine Bush Fire District will permanently provide fire protection services to the same properties within the Town of Crawford and to the same properties within the Town of Shawangunk at present. The only changes contemplated by this Agreement are the consolidation of the Pine Bush Fire District with the New Prospect Fire Protection District. After the consolidation contemplated by this Agreement, the New Prospect Fire Protection District will cease to exist.
  2. After the consolidation, the Pine Bush Fire District will be named and known as the Pine Bush Fire District of the Town of Crawford in the County of Orange and of the Town of Shawangunk in the County of Ulster.
  3. The rights and duties and obligations of the Pine Bush Fire District after the consolidation will remain the same as existed prior to the consolidation, except for the addition of the properties of the New Prospect Fire Protection District. In this regard, it is noted that for many years the properties of the New Prospect Fire Protection District have been provided fire protection services by the Pine Bush Fire District pursuant to annual contracts between the Town of Shawangunk and the Pine Bush Fire District.
  4. The territorial boundaries of the proposed consolidated governmental entity, to wit: the Pine Bush Fire District are as follows: portions of the Town of Crawford as described on Schedule “A” attached hereto and portions of the Town of Shawangunk as described on Schedule “B” attached hereto.
  5. The type and class of the proposed consolidated governmental entity, to wit: the Pine Bush Fire District will remain a district corporation and political subdivision of the State of New York.
  6. The governmental organization of the proposed consolidated governmental entity, to wit: the Pine Bush Fire District insofar as concerns elected and appointed positions will he  same as they existed prior to the consolidation, except that in all annual and special elections or referenda  held in the Pine Bush Fire District after  January 1, 2023, the qualified residents of the properties previously within the New Prospect Fire Protection District will be  electors of the consolidated Pine Bush Fire District. Elected positions will remain five (5) fire commissioners, each with a staggered five (5) year term. Appointed positions will remain one (1) fire district secretary and one (1) fire district treasurer.

There is no transitional plan or schedule for elections or appointments of officials of the Pine Bush Fire District inasmuch as the elected and appointed officials of the Pine Bush Fire District will remain as existed prior to the consolidation.

  1. There is no fiscal estimate of the cost of or savings which may be realized from consolidation for the reason that there will be no change in the operations of the Pine Bush Fire District or its fire department. There may be slight savings in the time expended by   the officials of the Town of Shawangunk and officials of the Pine Bush Fire District in negotiating the annual contact for fire protection coverage for the New Prospect Fire Protection District since the New Prospect Fire Protection District will not exist after January 1, 2023.
  2. The properties in each Town will bear an equitable share of the Fire District’s tax levy.  For example, the Fire District shall calculate the property tax levy to assure that a property with the same market value in each Town (after applying equalization rates to the assessed values) will pay the same amount of property tax.
  3. The New Prospect Fire Protection District has no assets other than a nominal cash account in the custody of the Town of Shawangunk with a present balance of less than $2,500.00.  The Pine Bush Fire District has the following assets: firehouse located at Route 52, Pine Bush, New York; firefighting tools and equipment including trucks and apparatus as described on Schedule “C” attached hereto.
  4. The New Prospect Fire Protection District has no liabilities or indebtedness. The Pine Bush Fire District has no liabilities or indebtedness other than current accounts for fire district and fire department obligations which are all paid monthly.
  5. There are no terms for the disposition of existing assets, liabilities and indebtedness of the affected local government entities, either jointly, separately or in certain defined proportions.
  6. All terms for the administration and enforcement of local laws, ordinances, resolutions, orders and the like within the proposed consolidated governmental entity, to wit: the Pine Bush Fire District will remain the same, consistent with section 769 of the General Municipal Law.
  7. The effective date of the proposed consolidation is January 1, 2023.
  8. The public hearing on this proposed joint consolidation agreement will be held at the Pine Bush Firehouse, located at Route 52, Pine Bush, New York on Tuesday, July 26, 2022 at 7:30 PM or at any later date subject to proper notice.

PUBLIC NOTICE is hereby given that there has been introduced before the Town Board of the Town of Crawford, New York, on June 16, 2022, a local law, titled “Increase In Maximum Floor Area of Warehouses In The Business Park Zoning District,” which local law would increase the permitted maximum total floor area of warehouse and distribution centers in the BP (Business Park) zoning district from 200,000 square feet to 400,000 square feet.

A complete copy of the Introductory Local Law is available for inspection at the Clerk's Office.

NOW, THEREFORE, pursuant to Section 20 of the Municipal Home Rule Law, the Town Board of the Town of Crawford, New York, will hold a public hearing on the aforesaid Local Law on July 21, 2022, at 7:00 P.M. or soon thereafter, at the Town Hall, 121 Route 302, Pine Bush, New York, 12566, at which time all persons interested therein shall be heard.

Introduce Zoning Amendment Regarding Warehouses in BP Zoning District

INCREASE IN MAXIMUM FLOOR AREA OF WAREHOUSES

IN THE BUSINESS PARK ZONING DISTRICT

 

            BE IT ENACTED by the Town Board of the Town of Crawford, County of Orange, State of New York, as follows:

 

            Section 1.        Legislative Intent.  Warehouse and distribution centers are permitted as a special permit use in the Business Park (BP) and Industrial (I) zoning districts.  In the BP zoning district, the size of warehouse and distribution centers is limited to not more than 200,000 square feet total floor area.  The Town Board recognizes that warehouse users and warehouse developers seek the benefits of larger warehouse and distribution centers, and that the 200,000 square foot limitation discourages construction of warehouse and distribution centers in the BP zoning district.  In addition, the Town Board recognizes that under the existing zoning law, a warehouse/distribution center developer could subdivide a parcel and seek approval for multiple adjoining warehouse buildings totaling 400,000 square feet or more of floor area.  The Board believes that one larger warehouse building is better planning and more protective of the environment than two or three adjoining warehouse buildings, and that the Planning Board’s review of individual applications will ensure appropriate site layouts and neighborhood and environmental protection.  Accordingly, the intent of this local law is to increase the permitted maximum floor area of warehouses and distribution centers to 400,000 square feet.

 

            The Town Board recognizes that the minimum lot size requirement in the BP zoning district is 2.5 acres, and that 2.5 acres is not adequate to accommodate a 400,000-square foot warehouse/distribution center and associated loading areas, parking, driveways, stormwater facilities and landscaping.  Since a warehouse or distribution center is a special permit use, the Planning Board possesses discretion to determine on individual applications whether the site is suitable for a warehouse or distribution center of the proposed floor area, given the site size and physical characteristics, surrounding area and other relevant factors.

 

            Section 2.        The Table of Use Regulations for the BP (Business Park) Zoning District, authorized by §137-8, titled “Table of Use Regulations,” of Chapter 137, titled “Zoning,” is amended by amending Item 8 of Column 2, titled “Special Permit Uses,” to read as follows:

 

            8.  Warehouse and distribution centers not larger than 400,000 square feet total floor area.

 

            Section 3.        This local law shall take effect immediately upon filing with the Secretary of State.

AFFORDABLE HOUSING IN BP-HAMLET ZONING DISTRICT

 

            BE IT ENACTED by the Town Board of the Town of Crawford, County of Orange, State of New York, as follows:

 

            Section 1.  Legislative Intent.  The intent of this local law is to allow and encourage the construction of affordable housing in the Business Park-Hamlet zoning district on sites that adjoin existing housing developments.  It is intended that such affordable dwelling units will be available for rent to work force, veteran, special needs and senior citizen occupants. 

 

            Section 2.  Column 2, titled “Special Permit Uses,” of the Table of Use Regulations for the BP (Business Park) Zoning District, authorized by §137-8, titled “Table of Use Regulations” of Chapter 137, titled “Zoning,” of the Code of the Town of Crawford is amended by adding a new special permit use, permitted only in the BP-Hamlet (Business Park-Hamlet) zoning district, to read as follows:

 

            17.       Affordable multiple dwellings (in BP-Hamlet zoning district only)

 

            Section 3.  Section 137-28, titled “Special conditions and safeguards for certain uses,” of Chapter 137, titled “Zoning,” of the Code of the Town of Crawford is amended by adding a new subsection W, titled “Affordable multiple dwellings in BP-Hamlet zoning district,” to read as follows:

 

            W.  Affordable multiple dwellings in BP-Hamlet zoning district. 

 

  1. All dwelling units shall be affordable to lower-income or moderate-income persons pursuant to income levels determined by New York State and/or Federal agencies.

 

  1. The provisions and requirements of §137-28E shall not apply.  Notwithstanding the bulk requirements contained in the Table of Dimensional Regulations for the BP-Hamlet zoning district, the bulk requirements shall be as follows:

 

  1. Minimum lot size:  2 acres
  2. Minimum lot width:  100 feet
  3. Minimum front yard setback:  75 feet
  4. Minimum side yard setback (each): 25 feet
  5. Minimum rear yard setback: 40 feet
  6. Maximum building height:  35 feet
  7. Maximum building coverage:  40%
  8. Minimum distance between buildings:  As determined by Planning Board during               special permit review
  9. Density:  20 dwelling units per gross acre
  10. Minimum habitable floor area:

1 bedroom:450 square feet

2 bedrooms: 700 square feet

3 bedrooms:800 square feet

 

  1. Mix of dwelling units:  One (1) three-bedroom dwelling unit is permitted for a             caretaker.  The remaining dwelling units shall be an equal number of one-   bedroom units and two-bedroom units. 
  2. Parking requirement:  1.5 spaces per dwelling unit

 

  1. Municipal water and sewer service must be available to service the site.

 

            Section 4.        Severability.  If a provision of any article, section, subsection, paragraph, subdivision or clause of this local law shall be adjudged invalid by a court of competent jurisdiction, such order or judgment shall not affect or invalidate the remainder of any article, section, subsection, paragraph, subdivision or clause of this local law.

 

            Section 5.        Supersession.  Pursuant to the state Municipal Home Rule Law, this local law is intended to and shall supersede any inconsistent provisions of the state Town Law and any other special law.

 

            Section 6.        Effective Date.  This local law shall take effect immediately upon filing with the Secretary of State.

Town of Crawford Supervisor Charles Carnes with the assistance of County Executive Steve Neuhaus and our County Legislator Rob Sassi have received and will be distributing a limited number of COVID 19 test kits to Town of Crawford and Orange County residents tomorrow Thursday, January 20th. We will have two times available: from 10am to 12pm noon and 5 pm to 7pm.

The line will start on Alice Court which is just past the Town park entrance and proceed thru our Highway Department facility and exit on Hardenburg Road.

To ensure that Town of Crawford residents receive these test kits identification may be necessary. This is a first come first serve basis and should be used only if you are exposed or have symptoms.

            PUBLIC NOTICE is hereby given that there has been introduced before the Town Board of the Town of Crawford, New York, on November 18, 2021, a local law entitled, “Amendment of Grievance Day,” which local law would establish the fourth Tuesday in May as the Town’s tax grievance day, reverting back to the standard tax grievance date established pursuant to NYS Real Property Tax Law § 512. A complete copy of the Introductory Local Law is available for inspection at the Clerk's Office and on the Town website.     

            NOW, THEREFORE, pursuant to Section 20 of the Municipal Home Rule Law, the Town Board of the Town of Crawford, New York, will hold a public hearing on the aforesaid Local Law at the Town of Crawford Town Hall, New York, on December 16, 2021, at 7:00 P.M., at which time all persons interested therein shall be heard.

            The Town of Crawford will make every effort to assure that the hearing is accessible to persons with disabilities.  Anyone requiring special assistance and/or reasonable accommodations should contact the Town Clerk.

Town of Crawford 2022 Budget Tax Decrease

Town of Crawford, 121 State Route 302, Pine Bush New York

Supervisor Charles E. Carnes is pleased to announce his final 2022 budget, which was approved by the Town Board at their November 18, 2021 meeting. For 2022 the general budget will show a decrease of 8.8 cents per thousand of assessed valuation.  This will be the 10th consecutive year where the Town is under the New York State tax cap.

Special districts will also have a decrease in the parking, lighting and sewer districts. The water district will show a slight increase in usage and tax rates as the Town undertakes approximately five million dollars in water improvements.

For the 2022 budget Supervisor Carnes is proud to increase police services for the safety of our residents as well as increased funding for senior programs and tourism to support our business owners. We will continue capital improvements for 2022 while giving our taxpayer a slight tax decrease despite ever increasing cost mandates from both the State and Federal Government.

It’s easy to begin! Your First Class: Arrive Fifteen minutes early, at 9:45 am, to fill out paperwork. Please bring something that certifies that your residency, (home address), is within the Town of Crawford.

Due to the warm weather we are extending the closing of the Town Parks and Walking Trail. The last day open will be Sunday, November 15th to avoid costly damage to our water and sewer line from freezing as well as the safety of our residents.
